Below are the civil and criminal penalties for writing a bad check in North Dakota under State Statute (Title 6 – Banks and Banking, Chapter 6-08 – General
Provisions, 6-08-16. Issuing check or draft without sufficient funds or credit – Notice – Time limitation – Financial liability – Penalty. The following applies if you do not
make good on the check plus fees within two weeks of a notice for a dishonored check being sent by the payee.
Civil Penalties: Amount due, collection fees and cost not to exceed $30, plus up to $200 in civil penalties or triple amount of the check, whichever is less.
Criminal Penalties: If the bad check is no more than $50 then it is considered a minor offense and the fine is $500. Dishonored checks between $50 and $250 or if you had a prior bad check offense in
the past 3 years you may be charged with a Class B misdemeanor that can result in a $1,000 fine and/or 30 days jail plus a $225 mandatory court fee. If the bogus check amount is more than $250 but
not more than $500 or if you have prior offenses of two or more bad check violations in the past three years you can be found guilty of a Class A misdemeanor that can result in a $2,000 fine and/or 1
year jail plus a mandatory court fee of $300. A Class C felony can result if the unpaid checks total more than $500 or if you had prior offenses of three or more bad check violations within the past
five years which can result in a $5,000 fine and/or 5 years in jail plus a mandatory court fee of $500. Additional costs in the amount of $10 or 25%, whichever is greater of the total amount of
restitution must also be imposed on defendants appearing in court for a bad check charge.
